Pleno - Aplicação do teto da EC 20/98 a aposentadorias anteriores (2/2) Assista neste vídeo aos votos dos ministros do Supremo Tribunal Federal (STF) no julgamento do Recurso Extraordinário (RE) 564354, ocorrido no dia 8 de setembro de 2010. Por maioria, o Plenário negou provimento ao RE, interposto na Corte pelo Instituto Nacional de Seguro Social (INSS) contra decisão que permitiu a aplicação do teto para aposentadoria, previsto na Emenda Constitucional (EC) 20/1998, ao benefício do recorrente, concedido antes da vigência da emenda. O autor da ação originária requereu aposentadoria por tempo de serviço proporcional em 1995. O INSS fez o cálculo do seu benefício, e aplicou o limitador vigente à época, que era de R$ 1.081,50. Com o advento da EC 1998, que elevou o teto dos benefícios previdenciários para R$ 1.200,00, o autor pediu a revisão de seu benefício, para que fosse aplicado o novo teto.
