Yamanami is ordered to commit seppuku by virtue of the Shinsengumi's code (he supposedly broke the code which states that members are not allowed to leave the group). However, everyone in the Shinsengumi knows that he was innocent (in fact, he deliberately left because, according to his conversation with Kondo Isami before his death, he was simply "tired" and had no place in the Shinsengumi anymore). This happened at the same time when their code was at its strictest implementation, especially by Hijikata Toshizo. Although it appears as if Hijikata and Yamanami cannot get along, in one of the scenes (not included here), Saitou tells Okita that both men have mutual respect for each other when he saw them working together.
