Direito Tributário Brasileiro - aula 1 O Curso de Direito Tributário Brasileiro, em cinco aulas, tem como objetivo apresentar os mais relevantes princípios constitucionais tributários, além de delinear as fundamentais características dos tributos indiretos - também nominados "sobre o consumo" - a saber: IPI, ICMS, ISSQN e PIS/COFINS. Na primeira aula o professor André Mendes trata do conceito de tributo, positivado no artigo 3º do Código Tributário Nacional, bem como das espécies tributárias existentes, apresentando as duas mais importantes correntes de pensamento sobre o assunto: a teoria tripartite (de acordo com a qual são tributos os impostos, as taxas e as contribuições de melhoria) e a teoria pentapartite (que adiciona às espécies tributárias os empréstimos compulsórios e as contribuições especiais). A segunda aula aborda os princípios da legalidade e da não-surpresa (que se desdobra na anterioridade anual e na noventena), assim como o princípio da proteção da confiança do contribuinte, intrinsecamente direcionado à irretroatividade da lei tributária, que somente admite poucas e tópicas exceções, todas positivadas no Código Tributário Nacional. Já o terceiro encontro, cuida do conceito de tributos indiretos ou sobre o consumo, teorizando sobre esta classificação e sua ligação com a não-cumulatividade tributária, que tem por característica tornar indiretos os tributos sobre os quais é aplicada. A quarta aula prossegue no estudo dos tributos indiretos, focando o ICMS e o ISSQN. A quinta e última aula trata da contribuição para o PIS e da COFINS.
